Business Breakfast at Nikolskaya: Litigating with Foreign Counterparties

On 11 March, Nikolskaya Consulting hosted a business breakfast dedicated to the pressing issues of litigation involving foreign entities, both in Russia and abroad.

Partners and lawyers from the Dispute and International Arbitration Practice shared their insights and expertise with the audience.

Alexey Panich analyzed the expanding scope of the Lugovoy Law. Attendees discussed the best strategies for selecting a forum and applicable law during the contract drafting stage to minimize the risks associated with this legislation.

Ivan Teselkin spoke about recovering damages and debts from foreign entities, highlighting recent case law from the Russian Supreme Court and lower courts. The Nikolskaya team evaluated the Supreme Court’s legal position in the Citibank and JP Morgan cases and outlined the future prospects for similar disputes.

Dmitry Malyukevich provided an overview of unconventional interim measures and anti-suit injunctions. The discussion explored when and how Russian companies should utilize these tools to strengthen their positions against foreign counterparties.

Dmitry Gloov addressed a highly relevant issue: legalizing Russian court decisions abroad. He focused on the specific steps needed both before and after a judgment is rendered to maximize the chances of successful overseas enforcement.
